Bài viết này giới thiệu khái quát các quan điểm lý thuyết về nguyên tắc loại trừ chứng cứ, cũng như chỉ ra xu hướng mà chúng được ghi nhận trong pháp luật Việt Nam, Hoa Kỳ và một số quốc gia ở Châu Âu, đồng thời đề xuất hướng hoàn thiện cho pháp luật Việt Nam.
