Bộ luật Dân sự năm 2015 của Việt Nam đã có sự tiến bộ trong việc ghi nhận các quy định pháp luật về quyền hưởng dụng, mặc dù vậy quyền hưởng dụng này vẫn được hiểu là quyền áp dụng cho cá nhân, tổ chức. Bài viết này phân tích quy định pháp luật về quyền hưởng dụng theo pháp luật của Hoa Kỳ, Phần Lan và Na Uy đối với các tộc người bản địa ở các nước này, trên cơ sở đó nhìn nhận lại các quy định của Bộ luật Dân sự hiện hành của Việt Nam về vấn đề này.
