Kể từ ngày có hiệu lực (16/11/1994) đến nay, Công ước của Liên hợp quốc về luật biển năm 1982 (United Nations Convention on the Law of the Sea, UNCLOS) đã khẳng định vai trò là “Hiến pháp về biển và đại dương”, khuôn khổ pháp lý quan trọng nhất để cộng đồng quốc tế quản trị biển và đại dương vì mục đích hòa bình và phát triển bền vững. Tuy nhiên, bước sang thế kỷ XX, UNCLOS đã bộc lộ những “khiếm khuyết” nhất định do chưa bao quát đầy đủ các vấn đề mới phát sinh từ thực tiễn. Tác giả bài viết này sẽ nghiên cứu và làm sáng tỏ ba thách thức cấp thiết đối với việc hoàn thiện UNCLOS gồm:(i) biến đổi khí hậu; (ii) an ninh hàng hải và (iii) bảo vệ quyền con người trên biển.
