Áp dụng quy phạm xung đột là yêu cầu cần thiết trong quá trình giải quyết các vụ việc dân sự có yếu tố nước ngoài. Tuy nhiên, áp dụng quy phạm xung đột được xem là quyền hay nghĩa vụ của tòa án có thẩm quyền? Đây là một vấn đề chưa được ghi nhận rõ ràng trong pháp luật quốc gia cũng như trong thực tiễn xét xử. Tác giả bài viết phân tích về thực tiễn áp dụng quy phạm xung đột trong quá trình giải quyết các vụ việc dân sự có yếu tố nước ngoài tại Cộng hòa Pháp, từ đó đưa ra một số gợi mở cho pháp luật và thực tiễn tại Việt Nam về vấn đề này.
