Trong vài thập kỷ gần đây, giảm thiểu việc giam giữ là mục tiêu và cũng là chính sách hình sự quan trọng trong pháp luật hình sự quốc tế và nhiều quốc gia. Để thực hiện chính sách này, các quốc gia dùng nhiều biện pháp thay thế cho việc giam giữ. Trong đó, các hình phạt cộng đồng có vai trò quan trọng và ngày càng được áp dụng phổ biến trong giai đoạn xét xử. Bằng các phương pháp nghiên cứu: lý thuyết luật học, so sánh luật, thống kê, tác giả đã làm rõ một số vấn đề lý luận, quy định trong pháp luật hình sự một số nước, thực trạng quy định và áp dụng hình phạt cộng đồng tại Việt Nam. Từ đó, bài viết đã gợi mở các hướng hoàn thiện quy định của luật hình sự Việt Nam về các hình phạt cộng đồng.
