Sự xuất hiện của tàu biển tự hành (Maritime Autonomous Surface Ship, MASS) đã đặt ra những thách thức pháp lý sâu sắc cho luật biển quốc tế, vốn được thiết kế trên nền tảng tàu có người điều khiển. Các điều ước như UNCLOS, SOLAS, COLREGs và STCW hiện không còn đủ khả năng điều chỉnh hiệu quả hoạt động của MASS, đặc biệt ở các mức độ tự động hóa cao. Bài viết này phân tích khoảng trống pháp lý quốc tế hiện hành, đánh giá thực trạng pháp luật Việt Nam và đề xuất một chiến lược tiếp cận đa tầng: từ cơ chế thử nghiệm pháp lý (sandbox), sửa đổi nội luật, đến tham gia chủ động vào tiến trình xây dựng pháp luật quốc tế cho MASS.
