Chế độ của học sinh trường giáo dưỡng: Nghiên cứu so sánh quy định của luật tư pháp người chưa thành niên với các chuẩn mực quốc tế

Luật Tư pháp người chưa thành niên năm 2024 (sửa đổi, bổ sung năm 2025) (Luật Tư pháp NCTN) đã thay đổi vị trí pháp lý của biện pháp tư pháp giáo dục tại trường giáo dưỡng theo Bộ luật Hình sự năm 2015 thành biện pháp xử lý chuyển hướng (XLCH). Sự thay đổi về hình thức cũng kéo theo các thay đổi về nội dung chế độ đối với học sinh trường giáo dưỡng, nhằm bảo đảm việc xử lý phù hợp với độ tuổi, khả năng nhận thức, đặc điểm nhân thân, tính chất nguy hiểm cho xã hội của hành vi phạm tội và tương thích với các chuẩn mực quốc tế về XLCH. Trong phạm vi nghiên cứu, nhóm tác giả tập trung phân tích đặc điểm pháp lý và mục đích của biện pháp giáo dục tại trường giáo dưỡng; đối chiếu các quy định của Luật Tư pháp NCTN về chế độ của học sinh trường giáo dưỡng với các chuẩn mực quốc tế; và kiến nghị hoàn thiện quy định của Luật Tư pháp NCTN về một số chế độ của học sinh trường giáo dưỡng.
