Từ nhu cầu cân bằng chính sách pháp luật đến các mô hình quyền tài sản đối với dữ liệu

Nhận thức được tầm quan trọng của dữ liệu - “dầu mỏ” của nền kinh tế số, Việt Nam đã tiên phong ban hành Luật Dữ liệu năm 2024 với cách tiếp cận đột phá khi trao cho chủ sở hữu dữ liệu một “quyền tài sản theo quy định của pháp luật về dân sự” đối với dữ liệu. Tuy nhiên, nội hàm quyền này chưa được giải thích cụ thể, trong khi đó vẫn tồn tại nhiều thách thức khác đến từ bản chất phức tạp của dữ liệu, những xung đột lợi ích, mâu thuẫn trong thị trường và chuỗi cung ứng dữ liệu, và sự đa dạng của các mô hình quyền tài sản với dữ liệu trên thế giới. Bài viết phân tích các lựa chọn chính sách pháp luật và phân tích hai mô hình lý thuyết có tính đại diện về quyền tài sản với dữ liệu, đồng thời kiến nghị mở rộng thảo luận liên ngành nhằm cụ thể hóa quyền tài sản với dữ liệu theo pháp luật dân sự Việt Nam.
