Thẩm quyền và thủ tục tố tụng trọng tài phụ trợ của ICSID: Điểm mới và lưu ý cho Việt Nam

Trong nhiều vụ kiện, các nhà đầu tư nước ngoài đã khởi kiện các quốc gia lên trọng tài phụ trợ của Trung tâm Giải quyết Tranh chấp Đầu tư Quốc tế (International Centre for Settlement of Investment Disputes, ICSID). Việc nghiên cứu thẩm quyền và thủ tục tố tụng trọng tài phụ trợ theo các quy tắc của ICSID năm 2022 là phù hợp và cần thiết tại thời điểm hiện tại. Sau khi phân tích so sánh, bài viết tìm thấy rằng (i) thẩm quyền của trọng tài phụ trợ được mở rộng theo chủ thể và thu hẹp theo vấn đề tranh chấp, (ii) phương thức tiếp cận, sử dụng cơ chế trọng tài phụ trợ được thuận lợi hoá, (iii) thời hạn cho phần lớn các hoạt động tố tụng được chi tiết hoá, (iv) cơ chế trọng tài rút gọn được thiết kế cho một số khiếu kiện. Từ đó, bài viết đưa ra một số lưu ý cho Việt Nam khi lựa chọn, sử dụng cơ chế trọng tài này.
